    1                        A bill to be entitled                      
    2         An act relating to a review under the Open Government
    3         Sunset Review Act; amending s. 815.04, F.S.;
    4         abrogating the scheduled repeal of a public records
    5         exemption for data, programs, or supporting
    6         documentation that is a trade secret held by an agency
    7         and which resides or exists internal or external to a
    8         computer, a computer system, a computer network, or an
    9         electronic device; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (3) of section 815.04, Florida
   14  Statutes, is amended to read:
   15         815.04 Offenses against intellectual property; public
   16  records exemption.—
   17         (3) Data, programs, or supporting documentation that is a
   18  trade secret as defined in s. 812.081, that is held by an agency
   19  as defined in chapter 119, and that resides or exists internal
   20  or external to a computer, computer system, computer network, or
   21  electronic device is confidential and exempt from the provisions
   22  of s. 119.07(1) and s. 24(a), Art. I of the State Constitution.
   23  This subsection is subject to the Open Government Sunset Review
   24  Act in accordance with s. 119.15 and shall stand repealed on
   25  October 2, 2021, unless reviewed and saved from repeal through
   26  reenactment by the Legislature.
   27         Section 2. This act shall take effect October 1, 2021.
