    1                        A bill to be entitled                      
    2         An act relating to a review under the Open Government
    3         Sunset Review Act; amending s. 502.222, F.S., which
    4         provides an exemption from public records requirements
    5         for a dairy industry business’ trade secrets held by
    6         the Department of Agriculture and Consumer Services;
    7         removing the scheduled repeal of the exemption;
    8         providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 502.222, Florida Statutes, is amended to
   13  read:
   14         502.222 Information relating to trade secrets
   15  confidential.—The records of the department regarding matters
   16  encompassed by this chapter are public records, subject to
   17  chapter 119, except that any information that would reveal a
   18  trade secret, as defined in s. 812.081, of a dairy industry
   19  business is confidential and exempt from s. 119.07(1) and s.
   20  24(a), Art. I of the State Constitution. If the department
   21  determines that any information requested by the public will
   22  reveal a trade secret, it shall, in writing, inform the person
   23  making the request of that determination. The determination is a
   24  final order as defined in s. 120.52. This section is subject to
   25  the Open Government Sunset Review Act in accordance with s.
   26  119.15 and shall stand repealed on October 2, 2021, unless
   27  reviewed and saved from repeal through reenactment by the
   28  Legislature.
   29         Section 2. This act shall take effect October 1, 2021.
