       Senator Berman moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 212 - 220
    4  and insert:
    5  includes evidence tending to demonstrate whether the defendant
    6  made such a good faith effort and evidence tending to
    7  demonstrate that the plaintiff’s damages, injury, or death was
    8  caused by the defendant’s acts or omissions.
    9         b. Considering all evidence submitted at this stage, if the
   10  court determines that the defendant made such a good faith
   11  effort, and the defendant’s acts or omissions were reasonable,
   12  given the circumstances, the defendant is immune from civil
   13  liability. If more than one source or set of standards or
   14  guidance was authoritative or controlling at the time the cause
   15  of action accrued, the defendant’s good faith effort to
   16  substantially comply with any one of those sources or sets of
   17  standards or guidance is admissible.
