       The Committee on Judiciary (Polsky) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 131 - 136
    4  and insert:
    5         (b) The plaintiff must present affidavit testimony from a
    6  qualified medical expert which attests to the expert’s belief,
    7  within a reasonable degree of certainty, that the plaintiff was
    8  positive for COVID-19 at the time that the cause of action
    9  accrued and that the plaintiff’s infection by COVID-19 resulted
   10  in injury, damages, or death.
