1 A bill to be entitled
2 An act relating to the administration of vaccines;
3 amending s. 465.189, F.S.; revising the specified
4 immunizations or vaccines that certified pharmacists
5 and registered interns may administer to adults;
6 authorizing certain pharmacists to administer
7 influenza vaccines to individuals 7 years of age or
8 older under certain circumstances; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Present subsections (2) through (8) of section
14 465.189, Florida Statutes, are redesignated as subsections (3)
15 through (9), respectively, a new subsection (2) is added to that
16 section, and subsection (1) and present subsection (6) are
17 amended, to read:
18 465.189 Administration of vaccines and epinephrine
19 autoinjection.—
20 (1) In accordance with guidelines of the Centers for
21 Disease Control and Prevention for each recommended immunization
22 or vaccine, a pharmacist, or a registered intern under the
23 supervision of a pharmacist who is certified under subsection
24 (7)(6), may administer the following immunizations or vaccines
25 to an adult within the framework of an established protocol
26 under a supervising physician licensed under chapter 458 or
27 chapter 459:
28 (a) Immunizations or vaccines listed in the Adult
29 Immunization Schedule as of February 1, 2015, by the United
30 States Centers for Disease Control and Prevention’s Recommended
31 Immunization Schedule, the United States Centers for Disease
32 Control and Prevention’s Health Information for International
33 Travel, or the United States Food and Drug Administration’s
34 Vaccines Licensed for Use in the United States or vaccines
35 authorized for emergency use by the United States Food and Drug
36 Administration Prevention. The board may authorize, by rule,
37 additional immunizations or vaccines as they are added to the
38 United States Centers for Disease Control and Prevention’s
39 Recommended Immunization Schedule, the United States Centers for
40 Disease Control and Prevention’s Health Information for
41 International Travel, or the United States Food and Drug
42 Administration’s Vaccines Licensed for Use in the United States
43 or additional vaccines authorized for emergency use by the
44 United States Food and Drug Administration Adult Immunization
45 Schedule.
46 (b) Immunizations or vaccines recommended by the United
47 States Centers for Disease Control and Prevention for
48 international travel as of July 1, 2015. The board may
49 authorize, by rule, additional immunizations or vaccines as they
50 are recommended by the United States Centers for Disease Control
51 and Prevention for international travel.
52 (c) Immunizations or vaccines approved by the board in
53 response to a state of emergency declared by the Governor
54 pursuant to s. 252.36.

56 A registered intern who administers an immunization or vaccine
57 under this subsection must be supervised by a certified
58 pharmacist at a ratio of one pharmacist to one registered
59 intern.
60 (2) A pharmacist who is certified under subsection (7) may
61 administer influenza vaccines to individuals 7 years of age or
62 older within the framework of an established protocol under a
63 supervising physician licensed under chapter 458 or chapter 459.
64 (7)(6) Any pharmacist or registered intern seeking to
65 administer vaccines to adults under this section must be
66 certified to administer such vaccines pursuant to a
67 certification program approved by the Board of Pharmacy in
68 consultation with the Board of Medicine and the Board of
69 Osteopathic Medicine. The certification program shall, at a
70 minimum, require that the pharmacist attend at least 20 hours of
71 continuing education classes approved by the board and the
72 registered intern complete at least 20 hours of coursework
73 approved by the board. The program shall have a curriculum of
74 instruction concerning the safe and effective administration of
75 such vaccines, including, but not limited to, potential allergic
76 reactions to such vaccines.
77 Section 2. This act shall take effect July 1, 2021.
