The Committee on Judiciary (Polsky) recommended the following:
1 Senate Amendment (with title amendment)

3 Between lines 53 and 54
4 insert:
5 (c) Evidence relating to determining a defendant’s ability
6 to compensate a plaintiff.—Notwithstanding s. 627.4136 or any
7 other provision of law, in order to determine the ability of the
8 defendant to compensate the claimant for medical expenses
9 incurred:
10 1. Evidence the defendant has insurance or other assets
11 available to compensate the claimant for medical expenses is
12 admissible;
13 2. Evidence of the amount of the defendant’s liability
14 insurance is not admissible; and
15 3. Evidence of the defendant declaring bankruptcy or
16 transferring assets after the cause of action accrues is
17 admissible.
