    1                        A bill to be entitled                      
    2         An act relating to the use of electronic databases;
    3         amending s. 119.10, F.S.; increasing the maximum fine
    4         imposed on public officers who violate any provision
    5         of ch. 119, F.S.; amending s. 943.125, F.S.; requiring
    6         the law enforcement accreditation program to address
    7         access to and use of personal identification
    8         information contained in electronic databases;
    9         creating s. 943.1719, F.S.; requiring the Criminal
   10         Justice Standards and Training Commission to
   11         incorporate into the course curriculum required for
   12         initial certification of law enforcement officers
   13         instruction on the authorized access to and use of
   14         personal identification information contained in
   15         electronic databases; providing training requirements;
   16         creating s. 943.17191, F.S.; requiring the commission
   17         to adopt rules requiring that each law enforcement
   18         officer receive instruction on the authorized access
   19         to and use of personal identification information
   20         contained in electronic databases for continued
   21         employment or appointment as an officer; providing
   22         training requirements; providing an effective date.
   23          
   24  Be It Enacted by the Legislature of the State of Florida:
   25  
   26         Section 1. Paragraph (a) of subsection (1) of section
   27  119.10, Florida Statutes, is amended to read:
   28         119.10 Violation of chapter; penalties.—
   29         (1) Any public officer who:
   30         (a) Violates any provision of this chapter commits a
   31  noncriminal infraction, punishable by fine not exceeding $2,000
   32  $500.
   33         Section 2. Paragraph (o) is added to subsection (4) of
   34  section 943.125, Florida Statutes, to read:
   35         943.125 Accreditation of state and local law enforcement
   36  agencies, correctional facilities, public agency offices of
   37  inspectors general, and certain pretrial diversion programs;
   38  intent.—
   39         (4) The law enforcement accreditation program must address,
   40  at a minimum, the following aspects of law enforcement:
   41         (o)Access to and use of personal identification
   42  information, as defined in s. 817.568(1)(f), contained in
   43  electronic databases.
   44         Section 3. Section 943.1719, Florida Statutes, is created
   45  to read:
   46         943.1719Basic skills training relating to the use of
   47  electronic databases.—The commission shall incorporate into the
   48  course curriculum required for initial certification of a law
   49  enforcement officer instruction on the authorized access to and
   50  use of personal identification information, as defined in s.
   51  817.568(1)(f), contained in electronic databases used by a law
   52  enforcement officer in his or her official capacity. This
   53  training must include, but need not be limited to, the proper
   54  use, and limitations on use, of electronic databases in a law
   55  enforcement officer’s official capacity and the penalties
   56  associated with the misuse of such electronic databases.
   57         Section 4. Section 943.17191, Florida Statutes, is created
   58  to read:
   59         943.17191Continued employment training relating to the use
   60  of electronic databases.—The commission shall by rule require
   61  that each law enforcement officer receive, as part of the 40
   62  hours of required instruction for continued employment or
   63  appointment as an officer, instruction on the authorized access
   64  to and use of personal identification information, as defined in
   65  s. 817.568(1)(f), contained in electronic databases used by a
   66  law enforcement officer in his or her official capacity. This
   67  training must include, but need not be limited to, the proper
   68  use, and limitations on use, of electronic databases in a law
   69  enforcement officer’s official capacity and the penalties
   70  associated with the misuse of such electronic databases.
   71         Section 5. This act shall take effect October 1, 2021.
