Senator Farmer moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 202 - 219
4 and insert:
5 (5)(a) An employee is eligible for reemployment assistance
6 under chapter 443 in addition to any other remedy available to
7 the employee in the following circumstances:
8 1. If an employer fails to comply with subsections (1) and
9 (2) and terminates an employee based on the employee’s
10 noncompliance with a COVID-19 vaccination mandate
11 2. An employee leaves employment because the employer does
12 not implement a COVID-19 vaccination mandate
13 3. An employee has to leave employment to care for an
14 immediate family member due to COVID-19 or other illness.
15 4. An employee loses employment due to a declared state of
16 emergency.
17 (b) If an employee is terminated for refusing to comply
18 with a COVID-19 vaccination mandate and the employer did not
19 offer and properly apply the exemptions required under this
20 section:
21 1. Such refusal may not be deemed misconduct for the
22 purpose of reemployment assistance under chapter 443.
23 2. Notwithstanding any provision of chapter 443, work is
24 not deemed suitable and benefits may not be denied under s.
25 443.101 to the terminated employee for refusing to accept new
26 work if the terminated employee is otherwise eligible and the
27 position requires compliance with a COVID-19 vaccination mandate
28 contrary to this section or s. 112.0441.
