    1                        A bill to be entitled                      
    2         An act relating to trust funds; amending s. 20.195,
    3         F.S.; creating the Opioid Settlement Trust Fund within
    4         the Department of Children and Families; providing for
    5         sources of moneys; providing for reversion of
    6         unencumbered and undisbursed balances; providing for
    7         future review and termination of the fund; providing
    8         an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (11) is added to section 20.195,
   13  Florida Statutes, to read:
   14         20.195 Department of Children and Families; trust funds.
   15  The following trust funds shall be administered by the
   16  Department of Children and Families:
   17         (11) Opioid Settlement Trust Fund.
   18         (a) The Opioid Settlement Trust Fund is created within the
   19  Department of Children and Families.
   20         (b) Funds to be credited to the trust fund shall consist of
   21  funds disbursed, by nonoperating transfer, from the Department
   22  of Financial Services Opioid Settlement Clearing Trust Fund in
   23  amounts equal to the annual appropriations made from this trust
   24  fund.
   25         (c) Notwithstanding s. 216.301 and pursuant to s. 216.351,
   26  any unencumbered balance in the trust fund at the end of any
   27  fiscal year and any encumbered balance remaining undisbursed on
   28  December 31 of the same calendar year shall revert to the
   29  Department of Financial Services Opioid Settlement Clearing
   30  Trust Fund.
   31         (d) In accordance with s. 19(f), Art. III of the State
   32  Constitution, the trust fund, unless terminated sooner, shall be
   33  terminated on July 1, 2026. Before its scheduled termination,
   34  the trust fund shall be reviewed as provided in s. 215.3206(1)
   35  and (2).
   36         Section 2. This act shall take effect July 1, 2022.
