       Senator Bradley moved the following:
       
    1         Senate Substitute for Amendment (635964) (with title
    2  amendment)
    3  
    4         Delete lines 189 - 196
    5  and insert:
    6  agency or in a local county detention facility as defined in s.
    7  951.23(1), if the certified nursing assistant or home health
    8  aide meets the requirements of s. 464.2035 or s. 400.489,
    9  respectively. A registered nurse may not delegate the
   10  administration of any controlled substance listed in Schedule
   11  II, Schedule III, or Schedule IV of s. 893.03 or 21 U.S.C. s.
   12  812, except for the administration of an insulin syringe that is
   13  prefilled with the proper dosage by a pharmacist or an insulin
   14  pen that is prefilled by the manufacturer.
   15         Section 4. Subsection (1) of section 464.2035, Florida
   16  Statutes, is amended to read:
   17         464.2035 Administration of medication.—
   18         (1) A certified nursing assistant may administer oral,
   19  transdermal, ophthalmic, otic, rectal, inhaled, enteral, or
   20  topical prescription medication to a patient of a home health
   21  agency or to a patient in a county detention facility as defined
   22  in s. 951.23(1) if the certified nursing assistant has been
   23  delegated such task by a registered nurse licensed under part I
   24  of this chapter, has satisfactorily completed an initial 6-hour
   25  training course approved by the board, and has been found
   26  competent to administer medication to a patient in a safe and
   27  sanitary manner. The training, determination of competency, and
   28  initial and annual validation required under this section must
   29  be conducted by a registered nurse licensed under this chapter
   30  or a physician licensed under chapter 458 or chapter 459.
