       Senator Albritton moved the following:
       
    1         Senate Amendment to Amendment (175492) (with title
    2  amendment)
    3  
    4         Delete lines 12 - 33
    5  and insert:
    6         (t) Failing to identify the name of a health care
    7  practitioner through written notice, which may include the
    8  wearing of a name tag or embroidered identification that also
    9  includes the professional, or orally to a patient the type of
   10  license and professional degree issued to the practitioner. If
   11  wearing a name tag is not feasible, the practitioner must
   12  provide written notice of such information under which the
   13  practitioner is practicing. Any advertisement for health care
   14  services naming the practitioner must identify the professional
   15  type of license and professional degree the practitioner holds
   16  and may not contain deceptive or misleading information,
   17  including, but not limited to, any affirmative communication or
   18  representation that misstates, falsely describes, holds out, or
   19  falsely details the health care practitioner’s skills, training,
   20  expertise, education, public or private board certification, or
   21  licensure. This paragraph does not apply to a practitioner while
   22  the practitioner is providing services in a facility licensed
   23  under chapter 394, chapter 395, chapter 400, or chapter 429.
   24  Each board, or The department shall where there is no board, is
   25  authorized by rule to determine how health care its
   26  practitioners must may comply with this disclosure requirement.

   29  And the title is amended as follows:
   30         Delete lines 41 - 46
   31  and insert:
   32         requiring the Department of Health, rather than each
   33         applicable board, to adopt rules for certain
   34         requirements related to identification and advertising
   35         of practitioner licensure and qualifications;
