    1                        A bill to be entitled                      
    2         An act relating to fees; amending s. 790.261, F.S.;
    3         authorizing the Department of Law Enforcement to
    4         charge a fee for each serial number or identifying
    5         mark it issues to reimburse itself for certain actual
    6         costs; requiring all moneys collected to be deposited
    7         into the Division of Licensing Trust Fund; providing a
    8         contingent effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Present subsections (4) and (5) of section
   13  790.261, Florida Statutes, as created by SB ___ or similar
   14  legislation, are redesignated as subsections (5) and (6),
   15  respectively, and a new subsection (4) is added to that section,
   16  to read:
   17         790.261 Manufacture or assembly of firearms without unique
   18  serial number or other identifying mark.—
   19         (4)The department may charge an applicant a fee for each
   20  serial number or identifying mark the department issues in an
   21  amount sufficient to reimburse itself for the actual costs
   22  associated with assigning a serial number or identifying mark to
   23  a firearm under this section and for conducting a background
   24  check under this section. All moneys collected pursuant to this
   25  section shall be deposited in the Division of Licensing Trust
   26  Fund, and the Legislature shall appropriate from the funds those
   27  amounts deemed necessary to administer this section.
   28         Section 2. This act shall take effect on the same date that
   29  SB ___ or similar legislation takes effect, if such legislation
   30  is adopted in the same legislative session or an extension
   31  thereof and becomes a law.
