       The Committee on Rules (Brodeur) recommended the following:
       
    1         Senate Substitute for Amendment (846854) (with title
    2  amendment)
    3  
    4         Delete lines 24 - 35
    5  and insert:
    6  from the Land Acquisition Trust Fund.
    7         1.The governing boards shall consider all of the following
    8  criteria in designating a wetland for inclusion on the list:
    9         a. The ecological value of the wetland, as determined by
   10  the physical and biological components of the environmental
   11  system.
   12         b. The effect of the wetland on water quality and flood
   13  mitigation.
   14         c. The ecosystem restoration value of the wetland.
   15         d. The inherent susceptibility of the wetland to
   16  development due to its geographical location or natural
   17  aesthetics.
   18         2. Before adopting or amending its list of critical
   19  wetlands, each governing board must notify the owner of any
   20  property that the district contemplates including on the list.
   21  At any time, an owner who wishes to have his or her property
   22  removed from the list must submit by certified mail to the
   23  district a letter requesting such removal. The letter must
   24  indicate that the owner wishes for his or her property to be
   25  removed from the list and must sufficiently identify such
   26  property to the governing board. The governing board shall
   27  approve a removal request that meets the requirements of this
   28  subparagraph at its next regularly scheduled meeting.

   31  And the title is amended as follows:
   32         Delete lines 7 - 9
   33  and insert:
   34         Acquisition Trust Fund; requiring the governing boards
   35         to consider certain criteria when including wetlands
   36         on the list and to notify owners of property
   37         contemplated to be included on the list; requiring
   38         owners who wish to have their property removed from
   39         the list to submit a certified letter requesting
   40         removal; providing requirements for any such request;
   41         requiring a governing board to approve such removal if
   42         the request meets those requirements; providing the
   43         timeframe for approval of requests; revising minimum
   44         requirements for annual strategic plans; providing an
   45         effective date.
