       Senator Rodrigues moved the following:
       
    1         Senate Substitute for Amendment (889914) (with title
    2  amendment)

    4         Between lines 77 and 78
    5  insert:
    6         Section 2. Subsection (2) of section 106.113, Florida
    7  Statutes, is amended to read:
    8         106.113 Expenditures by local governments.—
    9         (2) A local government or a person acting on behalf of
   10  local government may not expend or authorize the expenditure of,
   11  and a person or group may not accept, public funds for a
   12  political advertisement or any other electioneering
   13  communication sent to electors concerning an issue, referendum,
   14  or amendment, including any state question, that is subject to a
   15  vote of the electors. This subsection applies does not apply to
   16  a an electioneering communication initiated by from a local
   17  government or a person acting on behalf of a local government,
   18  irrespective of whether the communication which is limited to
   19  factual information or advocates for the passage or defeat of an
   20  issue, referendum, or amendment. This subsection does not
   21  preclude a local government or a person acting on behalf of a
   22  local government from reporting on official actions of the local
   23  government’s governing body in an accurate, fair, and impartial
   24  manner; posting factual information on a government website or
   25  in printed materials; hosting and providing information at a
   26  public forum; providing factual information in response to an
   27  inquiry; or providing information as otherwise authorized or
   28  required by law.
