Senator Polsky moved the following:
1 Senate Amendment (with title amendment)

3 Delete lines 555 - 558
4 and insert:
5 (1) Notwithstanding any provision of s. 624.155, a claimant
6 must establish that the property insurer breached the insurance
7 contract to prevail in a claim for extracontractual damages
8 under s. 624.155(1)(b).
9 (2) Notwithstanding any other provision of law, for any
10 property insurance coverage subject to this chapter issued or
11 renewed on or after the effective date of this act, every
12 insurer must reduce its rates to levels that are at least 2
13 percent less than the rates for the same coverage that was in
14 effect on January 1, 2022.
