Senator Farmer moved the following:

4 insert:
5 Section 22. (1) The Department of Revenue shall use the
6 revenue from the premium tax collected under s. 624.509, Florida
7 Statutes, to issue rebates to homeowners who have experienced
8 residential property insurance premium increases of 15 percent
9 or more. A homeowner is eligible if the premium for the policy
10 year has increased by 15 percent or more over the premium for
11 the previous policy year. By August 31, 2022, and annually
12 thereafter, a homeowner may apply to the department for a
13 rebate. The department may request information from the
14 homeowner which is necessary to determine the homeowner’s
15 eligibility. If the department determines that the homeowner is
16 eligible, the department must issue a rebate in the amount of
17 the premium increase. If the total revenue from the premium tax
18 is insufficient to issue rebates to all homeowners determined
19 eligible by the department, the department shall distribute
20 rebates proportionately based on the amounts for which each
21 homeowner is eligible.
22 (2) The department is authorized, and all conditions are
23 deemed met, to adopt emergency rules pursuant to s. 120.54(4),
24 Florida Statutes, for the purpose of administering this section.
25 (3) Notwithstanding any other law, emergency rules adopted
26 pursuant to subsection (2) are effective for 6 months after
27 adoption and may be renewed during the pendency of procedures to
28 adopt permanent rules addressing the subject of the emergency
29 rules.
