       Senator Farmer moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 652 and 653
    4  insert:
    5         Section 11. Section 626.7452, Florida Statutes, is amended
    6  to read:
    7         626.7452 Managing general agents; examination authority;
    8  required report.—
    9         (1) The acts of the managing general agent are considered
   10  to be the acts of the insurer on whose behalf it is acting. A
   11  managing general agent may be examined as if it were the
   12  insurer.
   13         (2)The Office of Insurance Regulation shall analyze the
   14  use of managing general agents (MGAs) by the insurance industry
   15  within this state. By December 1, 2022, the office shall publish
   16  on its website and submit to the President of the Senate and the
   17  Speaker of the House of Representatives a report that must
   18  include, at a minimum, data on the number of MGAs active in this
   19  state; the number of policies serviced by MGAs; the number of
   20  claims settled by MGAs; all monies paid to all MGAs by insurance
   21  companies, separately specified for each MGA and insurance
   22  carrier; and other functions frequently performed by MGAs.
