       The Committee on Rules (Ingoglia) recommended the following:
       
    1         Senate Substitute for Amendment (493202) (with title
    2  amendment)

    4         Delete lines 168 - 169
    5  and insert:
    6         Section 4. Subsection (3) is added to section 177.071,
    7  Florida Statutes, to read:
    8         177.071 Approval of plat by governing bodies.—
    9         (3)(a) On or before August 15, 2023, the governing body of
   10  each county and municipality shall establish a program to
   11  expedite the process for issuing building permits for approved
   12  residential subdivisions. Each county and municipality shall
   13  provide the Department of Economic Opportunity a letter
   14  certifying that the program is established and shall include an
   15  explanation of the program with the letter.
   16         (b) Upon a request by an applicant desiring to participate
   17  in the program established under this subsection, the local
   18  governing body shall issue up to 50 percent of the completed and
   19  approved building permits for homes identified in the
   20  application so long as the homes are not occupied and all of the
   21  following conditions apply:
   22         1. The project has an approved temporary plat or
   23  preliminary plat, or its functional equivalent.
   24         2. The applicant has provided a copy of the approved
   25  temporary plat or preliminary plat along with the approved civil
   26  engineering plans to the electric, water, and wastewater
   27  utilities.
   28         3. The applicant has provided a performance bond for
   29  necessary utilities, road, and stormwater improvements that have
   30  not been completed by the time the applicant applies for the
   31  program.
   32         (c) An applicant desiring to participate in the program
   33  established under this subsection may contract to sell but may
   34  not transfer ownership of a home in the residential subdivision
   35  until a final plat is approved and recorded in the public
   36  records of the local governing body.
