       The Appropriations Committee on Education (Jones) recommended
       the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 1321 and 1322
    4  insert:
    5         Section 5. Paragraph (c) of subsection (3) of section
    6  1002.421, Florida Statutes, is amended to read:
    7         1002.421 State school choice scholarship program
    8  accountability and oversight.—
    9         (3) COMMISSIONER OF EDUCATION AUTHORITY AND OBLIGATIONS.
   10  The Commissioner of Education:
   11         (c) May permanently deny or revoke the authority of an
   12  owner or operator to establish or operate a private school in
   13  the state and include such individual on the disqualification
   14  list maintained by the department pursuant to s. 1001.10(4)(b)
   15  if the commissioner decides that the owner or operator:
   16         1. Is operating or has operated an educational institution
   17  in the state or another state or jurisdiction in a manner
   18  contrary to the health, safety, or welfare of the public; or
   19         2.Has operated an educational institution that closed
   20  during the school year. An individual may be removed from the
   21  disqualification list if the individual reimburses the
   22  department or eligible nonprofit scholarship-funding
   23  organization the amount of scholarship funds received by the
   24  educational institution during the school year in which it
   25  closed, and shall include such individuals on the
   26  disqualification list maintained by the department pursuant to
   27  s. 1001.10(4)(b).

   29  The commissioner’s order suspending payment pursuant to this
   30  paragraph may be appealed pursuant to the same procedures and
   31  timelines as the notice of proposed action set forth in
   32  subparagraph (d)2.
