The Committee on Education Pre-K -12 (Jones) recommended the
following:
1 Senate Amendment (with directory and title amendments)

3 Between lines 1255 and 1256
4 insert:
5 (k) Impose a fine, as determined pursuant to subsection
6 (12), for any eligible private school that accepted scholarship
7 funds and closed or otherwise ceased operations before the end
8 of the school year.
9 1. The fine must be equivalent to 25 percent of the total
10 scholarship funds accepted by the school.
11 2. The department shall impose the fine on the school, and
12 the owner or operator shall remain liable.
13 3. The fine may not be imposed if the school gives notice,
14 at least 90 days in advance, of closure or operations ceasing.
