    1                        A bill to be entitled                      
    2         An act relating to federal law enforcement agency
    3         records; amending s. 119.01, F.S.; revising the
    4         general state policy on public records to include
    5         certain federal law enforcement agency records;
    6         amending s. 119.011, F.S.; revising definitions;
    7         creating s. 119.013, F.S.; requiring certain federal
    8         law enforcement agencies to comply with the public
    9         records requirements of this state; providing an
   10         effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (1) of section 119.01, Florida
   15  Statutes, is amended to read:
   16         119.01 General state policy on public records.—
   17         (1) It is the policy of this state that all state, county,
   18  and municipal records, and the records of federal law
   19  enforcement agencies that are not subject to the Freedom of
   20  Information Act and which have physical offices located in this
   21  state, are open for personal inspection and copying by any
   22  person. Providing access to public records is a duty of each
   23  agency.
   24         Section 2. Subsections (2) and (5) of section 119.011,
   25  Florida Statutes, are amended to read:
   26         119.011 Definitions.—As used in this chapter, the term:
   27         (2) “Agency” means any state, county, district, authority,
   28  or municipal officer, department, division, board, bureau,
   29  commission, or other separate unit of government created or
   30  established by law, including, for the purposes of this chapter,
   31  the Commission on Ethics, the Public Service Commission, and the
   32  Office of Public Counsel;, and any other public or private
   33  agency, person, partnership, corporation, or business entity
   34  acting on behalf of any public agency; and any federal law
   35  enforcement agency that is not subject to the Freedom of
   36  Information Act and which has a physical office located in this
   37  state.
   38         (5) “Custodian of public records” means the elected or
   39  appointed state, county, or municipal, or federal officer
   40  charged with the responsibility of maintaining the office having
   41  public records, or his or her designee.
   42         Section 3. Section 119.013, Florida Statutes, is created to
   43  read:
   44         119.013Federal law enforcement agency records.—A federal
   45  law enforcement agency that is not subject to the Freedom of
   46  Information Act and that has a physical office located in this
   47  state shall comply with the public records requirements of this
   48  state.
   49         Section 4. This act shall take effect July 1, 2023.
