1 A bill to be entitled
2 An act relating to ratification of rules of the
3 Department of Environmental Protection; ratifying
4 specified rules relating to standards for onsite
5 sewage treatment and disposal systems and for domestic
6 wastewater facility planning for facilities expansion,
7 collection/transmission systems, and an operation and
8 maintenance manual for the sole and exclusive purpose
9 of satisfying any condition on effectiveness pursuant
10 to s. 120.541(3), F.S., which requires ratification of
11 any rule exceeding the specified thresholds for likely
12 adverse impact or increase in regulatory costs;
13 providing construction; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. (1) The following rules are ratified for the
18 sole and exclusive purpose of satisfying any condition on the
19 effectiveness imposed under section 120.541(3), Florida
20 Statutes:
21 (a) Rule 62-6.001, Florida Administrative Code, titled
22 “General,” as filed for adoption with the Department of State
23 pursuant to the certification package dated May 10, 2022.
24 (b) Rules 62-600.405, 62-600.705, and 62-600.720, Florida
25 Administrative Code, titled “Domestic Wastewater Facilities:
26 Planning for Wastewater Facilities Expansion,” “Domestic
27 Wastewater Facilities: Collection/Transmission Systems,” and
28 “Domestic Wastewater Facilities: Operation and Maintenance
29 Manual,” respectively, as filed for adoption with the Department
30 of State pursuant to the certification package dated November
31 16, 2021.
32 (2) This act serves no other purpose and may not be
33 codified in the Florida Statutes. After this act becomes a law,
34 its enactment and effective dates must be noted in the Florida
35 Administrative Code, the Florida Administrative Register, or
36 both, as appropriate. This act does not alter rulemaking
37 authority delegated by prior law, does not constitute
38 legislative preemption of or exception to any provision of law
39 governing adoption or enforcement of the rule cited, and is
40 intended to preserve the status of any cited rule as a rule
41 under chapter 120, Florida Statutes. This act does not cure any
42 rulemaking defect or preempt any challenge based on a lack of
43 authority or a violation of the legal requirements governing the
44 adoption of any rule cited.
45 Section 2. This act shall take effect upon becoming a law.
