Senator Davis moved the following:

3 Delete lines 781 - 812
4 and insert:
5 determination of eligibility is made. A voter who votes using a
6 provisional ballot may not be charged with an offense for a
7 violation pursuant to chapter 104, Florida Statutes.”
8 2. If the mailed notice is returned as undeliverable, the
9 supervisor must, within 14 days after receiving the returned
10 notice, either shall publish notice once in a newspaper of
11 general circulation in the county in which the voter was last
12 registered or publish notice on the county’s website as provided
13 in s. 50.0311 or on the supervisor’s website, as deemed
14 appropriate by the supervisor. The notice must shall contain the
15 following:
16 a. The voter’s name and address.
17 b. A statement that the voter is potentially ineligible to
18 be registered to vote.
19 c. A statement that failure to respond within 30 days after
20 the notice is published may result in a determination of
21 ineligibility by the supervisor and removal of the registered
22 voter’s name from the statewide voter registration system.
23 d. An instruction for the voter to contact the supervisor
24 no later than 30 days after the date of the published notice to
25 receive information regarding the basis for the potential
26 ineligibility and the procedure to resolve the matter.
27 e. An instruction to the voter that, if further assistance
28 is needed, the voter should contact the supervisor of elections
29 of the county in which the voter is registered.
30 f. A statement that, if the voter denies the accuracy of
31 the information underlying the potential ineligibility, the
32 voter has a right to request a hearing for the purpose of
33 determining eligibility.
34 g. The following statement: “If you attempt to vote at an
35 early voting site or your normal election day polling place, you
36 will be required to vote a provisional ballot. If you vote by
37 mail, your ballot may not be accepted until a final
38 determination of eligibility is made. A voter who votes using a
39 provisional ballot may not be charged with an offense for a
40 violation pursuant to chapter 104, Florida Statutes.”
