    2         An act relating to amendments to land development
    3         regulations; amending s. 163.3167, F.S.; prohibiting
    4         an initiative or referendum process on land
    5         development regulation amendments; revising
    6         legislative intent to conform to changes made by the
    7         act; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraphs (a) and (c) of subsection (8) of
   12  section 163.3167, Florida Statutes, are amended to read:
   13         163.3167 Scope of act.—
   14         (8)(a) An initiative or referendum process in regard to any
   15  development order or any amendment to land development
   16  regulations is prohibited.
   17         (c) It is the intent of the Legislature that an initiative
   18  and referendum process be prohibited in regard to any
   19  development order or any amendment to land development
   20  regulations. It is the intent of the Legislature that an
   21  initiative and referendum process be prohibited in regard to any
   22  local comprehensive plan amendment or map amendment, except as
   23  specifically and narrowly allowed by paragraph (b). Therefore,
   24  the prohibition on any such initiative and referendum process
   25  stated in paragraphs (a) and (b) is remedial in nature and
   26  applies retroactively to any initiative or referendum process
   27  commenced after June 1, 2011, and any such initiative or
   28  referendum process commenced or completed thereafter is deemed
   29  null and void and of no legal force and effect.
   30         Section 2. This act shall take effect July 1, 2023.
