       Senator Martin moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 31 - 43
    4  and insert:
    5  unlawfully, commits or who keeps and maintains a place where
    6  alcoholic beverages are sold unlawfully, is guilty of a
    7  misdemeanor of the second degree, punishable as provided in s.
    8  775.082 or s. 775.083.
    9         (b)Any person, including a licensee, who unlawfully sells
   10  alcoholic beverages at a commercial establishment or keeps and
   11  maintains a place where alcoholic beverages are sold or intended
   12  to be sold unlawfully commits a felony of the third degree,
   13  punishable as provided in s. 775.082, s. 775.083, or s. 775.084,
   14  and must pay a fine of not less than $5,000 and not more than
   15  $10,000.
   16         (2)Any person, including a licensee, who commits a second
   17  or subsequent violation
