1 A bill to be entitled
2 An act relating to forms of identification; amending
3 s. 97.0535, F.S.; expanding the list of acceptable
4 forms of identification for certain voter registration
5 applicants to include United States passport cards,
6 identification cards issued by a federally recognized
7 tribal nation or Indian tribe, and United States
8 Merchant Mariner Credentials; amending s. 322.14,
9 F.S.; requiring that driver licenses issued to drivers
10 denote certain individuals as noncitizens; reenacting
11 ss. 101.6921(1) and 101.6923(1), F.S., relating to
12 certain voters who are required to submit certain
13 identification before voting, to incorporate the
14 amendment made to s. 97.0535, F.S., in references
15 thereto; reenacting s. 322.01(6), F.S., relating to
16 the definition of the term “color photographic driver
17 license,” to incorporate the amendment made to s.
18 322.14, F.S., in a reference thereto; providing an
19 effective date.

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. Paragraph (a) of subsection (3) of section
24 97.0535, Florida Statutes, is amended to read:
25 97.0535 Special requirements for certain applicants.—
26 (3)(a) The following forms of identification are shall be
27 considered current and valid if they contain the name and
28 photograph of the applicant and have not expired:
29 1. United States passport or passport card.
30 2. Debit or credit card.
31 3. Military identification.
32 4. Student identification.
33 5. Retirement center identification.
34 6. Neighborhood association identification.
35 7. Public assistance identification.
36 8. Veteran health identification card issued by the United
37 States Department of Veterans Affairs.
38 9. A license to carry a concealed weapon or firearm issued
39 pursuant to s. 790.06.
40 10. Employee identification card issued by any branch,
41 department, agency, or entity of the Federal Government, the
42 state, a county, or a municipality.
43 11. Identification card issued by a federally recognized
44 tribal nation or Indian tribe.
45 12. United States Merchant Mariner Credential.
46 Section 2. Paragraph (g) is added to subsection (1) of
47 section 322.14, Florida Statutes, to read:
48 322.14 Licenses issued to drivers.—
49 (1)
50 (g) Licenses issued to individuals who submitted any of the
51 documents required pursuant to s. 322.08(2)(c)5., 7., or 8. must
52 include “NC” to denote that such individual is a noncitizen.
53 Section 3. For the purpose of incorporating the amendment
54 made by this act to section 97.0535, Florida Statutes, in
55 references thereto, subsection (1) of section 101.6921, Florida
56 Statutes, is reenacted to read:
57 101.6921 Delivery of special vote-by-mail ballot to certain
58 first-time voters.—
59 (1) The provisions of this section apply to voters who are
60 subject to the provisions of s. 97.0535 and who have not
61 provided the identification or certification required by s.
62 97.0535 by the time the vote-by-mail ballot is mailed.
63 Section 4. For the purpose of incorporating the amendment
64 made by this act to section 97.0535, Florida Statutes, in
65 references thereto, subsection (1) of section 101.6923, Florida
66 Statutes, is reenacted to read:
67 101.6923 Special vote-by-mail ballot instructions for
68 certain first-time voters.—
69 (1) This section applies to voters who are subject to s.
70 97.0535 and who have not provided the identification or
71 information required by s. 97.0535 by the time the vote-by-mail
72 ballot is mailed.
73 Section 5. For the purpose of incorporating the amendment
74 made by this act to section 322.14, Florida Statutes, in a
75 reference thereto, subsection (6) of section 322.01, Florida
76 Statutes, is reenacted to read:
77 322.01 Definitions.—As used in this chapter:
78 (6) “Color photographic driver license” means a color
79 photograph of a completed driver license form meeting the
80 requirements prescribed in s. 322.14.
81 Section 6. This act shall take effect July 1, 2024.
