    1                        A bill to be entitled                      
    2         An act relating to the Estero Bay Aquatic Preserve;
    3         amending s. 258.39, F.S.; revising the boundaries of
    4         the Estero Bay Aquatic Preserve; providing an
    5         effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Subsection (28) of section 258.39, Florida
   10  Statutes, is amended to read:
   11         258.39 Boundaries of preserves.—The submerged lands
   12  included within the boundaries of Nassau, Duval, St. Johns,
   13  Flagler, Volusia, Brevard, Indian River, St. Lucie, Charlotte,
   14  Pinellas, Martin, Palm Beach, Miami-Dade, Monroe, Collier, Lee,
   15  Citrus, Franklin, Gulf, Bay, Okaloosa, Marion, Santa Rosa,
   16  Hernando, and Escambia Counties, as hereinafter described, with
   17  the exception of privately held submerged lands lying landward
   18  of established bulkheads and of privately held submerged lands
   19  within Monroe County where the establishment of bulkhead lines
   20  is not required, are hereby declared to be aquatic preserves.
   21  Such aquatic preserve areas include:
   22         (28) Estero Bay Aquatic Preserve, the boundaries of which
   23  are generally: All of those sovereignty submerged lands located
   24  bayward of the mean high-water line being in Sections 13, 14,
   25  15, 16, 17, 18, 21, 22, 23, 24, 25, 26, 27, 35, and 36, Township
   26  46 South, Range 24 East; and in Sections 19, 20, 28, 29, and 34,
   27  Township 46 South, Range 24 East, lying north and east of
   28  Matanzas Pass Channel; and in Sections 19, 30, and 31, Township
   29  46 South, Range 25 East; and in Sections 6, 7, 17, 18, 19, 20,
   30  29, 30, 31, and 32, Township 47 South, Range 25 East; and in
   31  Sections 1, 2, 3, 11, 12, 13, 14, 24, and 25, Township 47 South,
   32  Range 24 East, in Lee County, Florida. Any and all submerged
   33  lands conveyed by the Trustees of the Internal Improvement Trust
   34  Fund prior to October 12, 1966, and any and all uplands now in
   35  private ownership are specifically exempted from this preserve.

   37  Any and all submerged lands theretofore conveyed by the Trustees
   38  of the Internal Improvement Trust Fund and any and all uplands
   39  now in private ownership are specifically exempted from this
   40  dedication.
   41         Section 2. This act shall take effect July 1, 2024.
