       The Committee on Fiscal Policy (Wright) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 1001.433, Florida Statutes, is created
    6  to read:
    7         1001.433Patriotic organizations.—
    8         (1)As used in this section, the term “patriotic
    9  organization” means a youth membership organization serving
   10  young people under the age of 21 which is listed in Title 36,
   11  U.S.C., as it existed on January 1, 2020, with an educational
   12  purpose that promotes patriotism and civic involvement.
   13         (2)(a)Each school district may:
   14         1.Allow a representative of a patriotic organization the
   15  opportunity, during school hours and instructional time, to
   16  speak with and distribute informational materials in a classroom
   17  setting to students, to encourage participation in the patriotic
   18  organization and its activities, and to inform students of how
   19  the patriotic organization may further the students’ educational
   20  interests and civic involvement and better the students’ school
   21  and community and themselves.
   22         2.Provide opportunities for a patriotic organization to
   23  provide displays at schools within the district for student
   24  recruitment. Such displays may include informational flyers and
   25  the use of other existing communication channels.
   26         (b)If a school district authorizes a representative of a
   27  patriotic organization to speak with and distribute
   28  informational materials to students and provide displays
   29  pursuant to paragraph (a), the school district:
   30         1. Must provide a specific date and time for the patriotic
   31  organization to speak to students at schools within the district
   32  after the patriotic organization has provided reasonable notice
   33  of its intent to speak to students and provide displays.
   34         2. Must notify parents or guardians of each patriotic
   35  organization’s expected presentation and the option to withhold
   36  consent for their child participating in such presentation.
   37         (3)A school district may not discriminate against an
   38  organization in subsection (1) in the use of any school building
   39  or property for the purposes of paragraphs (2)(a) and (b), if
   40  such activities occur outside of the school day.
   41         (4)A school district that allows a patriotic organization
   42  to speak with and distribute informational materials to students
   43  or use school buildings or property pursuant to this section is
   44  not required to provide equal access to an organization that is
   45  not designated as a patriotic organization.
   46         Section 2. This act shall take effect July 1, 2024.

   53         An act relating to patriotic organizations; creating
   54         s. 1001.433, F.S.; defining the term “patriotic
   55         organization”; authorizing school districts to allow
   56         representatives of patriotic organizations to speak to
   57         students, distribute certain materials, and provide
   58         opportunities for certain displays relating to the
   59         patriotic organizations; requiring certain school
   60         districts to provide a date and time for such
   61         patriotic organizations to speak with students,
   62         distribute materials, and provide certain displays;
   63         specifying certain requirements if a school district
   64         allows a patriotic organization to present at the
   65         school; prohibiting a school district from
   66         discriminating against certain organizations in the
   67         use of a school building or property under certain
   68         circumstances; authorizing patriotic organizations to
   69         be provided certain access to school buildings and
   70         properties under certain circumstances; providing
   71         construction; providing an effective date.
