       The Committee on Fiscal Policy (Wright) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 1001.433, Florida Statutes, is created
    6  to read:
    7         1001.433Patriotic organizations.—
    8         (1)As used in this section, the term “patriotic
    9  organization” means a youth membership organization serving
   10  young people under the age of 21 with an educational purpose
   11  that promotes patriotism and civic involvement which is listed
   12  in Title 36, U.S.C. ss. 30101, 30901, 31101, 40301, 70901,
   13  80301, 130501, 140101, and 154101.
   14         (2)(a)Each school district may:
   15         1.Allow a representative of a patriotic organization the
   16  opportunity, during school hours and instructional time, to
   17  speak with and distribute informational materials in a classroom
   18  setting to students, to encourage participation in the patriotic
   19  organization and its activities, and to inform students of how
   20  the patriotic organization may further the students’ educational
   21  interests and civic involvement and better the students’ school
   22  and community and themselves.
   23         2.Provide opportunities for a patriotic organization to
   24  provide displays at schools within the district for student
   25  recruitment. Such displays may include informational flyers and
   26  the use of other existing communication channels.
   27         (b)If a school district authorizes a representative of a
   28  patriotic organization to speak with and distribute
   29  informational materials to students and provide displays
   30  pursuant to paragraph (a), the school district:
   31         1. Must provide a specific date and time for the patriotic
   32  organization to speak to students at schools within the district
   33  after the patriotic organization has provided reasonable notice
   34  of its intent to speak to students and provide displays.
   35         2. Must notify parents or guardians of each patriotic
   36  organization’s expected presentation and the option to withhold
   37  consent for their child participating in such presentation.
   38         (3)A school district may not discriminate against an
   39  organization in subsection (1) in the use of any school building
   40  or property for the purposes of paragraphs (2)(a) and (b), if
   41  such activities occur outside of the school day.
   42         (4)A school district that allows a patriotic organization
   43  to speak with and distribute informational materials to students
   44  or use school buildings or property pursuant to this section is
   45  not required to provide equal access to an organization that is
   46  not designated as a patriotic organization.
   47         Section 2. This act shall take effect July 1, 2024.

   54         An act relating to patriotic organizations; creating
   55         s. 1001.433, F.S.; defining the term “patriotic
   56         organization”; authorizing school districts to allow
   57         representatives of patriotic organizations to speak to
   58         students, distribute certain materials, and provide
   59         opportunities for certain displays relating to the
   60         patriotic organizations; requiring certain school
   61         districts to provide a date and time for such
   62         patriotic organizations to speak with students,
   63         distribute materials, and provide certain displays;
   64         specifying certain requirements if a school district
   65         allows a patriotic organization to present at the
   66         school; prohibiting a school district from
   67         discriminating against certain organizations in the
   68         use of a school building or property under certain
   69         circumstances; authorizing patriotic organizations to
   70         be provided certain access to school buildings and
   71         properties under certain circumstances; providing
   72         construction; providing an effective date.
