1 A bill to be entitled
2 An act relating to review of agency rules; amending s.
3 120.545, F.S.; requiring each state agency to annually
4 compile a specified report, by a specified date;
5 requiring the Administrative Procedures Committee to
6 advise and assist state agencies with specified
7 actions; requiring the staff director of the committee
8 to prepare a certain report annually, by a specified
9 date, and to publish such report on the committee’s
10 website and submit such report to the Legislature;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (9) is added to section 120.545,
16 Florida Statutes, to read:
17 120.545 Committee review of agency rules.—
18 (9)(a) By October 1, 2024, and each October 1 thereafter,
19 each state agency and each board under a state agency shall
20 compile a report that includes an inventory of all rules adopted
21 by such agency or board and all of the following information:
22 1. The total number of rules currently in effect under the
23 jurisdiction of the agency or the board.
24 2. The number of rules adopted by the agency or board in
25 the preceding year.
26 3. The number of rules withdrawn by the agency or board in
27 the preceding year.
28 4. A regulatory review exercise proposing reductions in
29 rules by 10 percent, 20 percent, and 30 percent of the total
30 rules currently in effect for the agency or board.
31 (b) The committee shall advise and assist state agencies in
32 preparing base and revised inventories of rules and shall advise
33 and assist agencies in achieving the specified percentage
34 reduction in rules in the Florida Administrative Code, including
35 exercises of proposed reductions of rule inventory by 10
36 percent, 20 percent, and 30 percent.
37 (c) Beginning December 1, 2024, and each December 1
38 thereafter, the staff director of the committee shall prepare a
39 historical report aggregating the reports received from state
40 agencies for the preceding year. In the report, the staff
41 director shall describe the work of the committee over the
42 preceding year with respect to reduction of rules and shall
43 indicate the percentage by which each state agency reduced its
44 rules. The report must provide recommendations to the
45 Legislature identifying those statutory changes brought to the
46 committee’s attention as contributing to the adoption of
47 regulatory restrictions. The staff director shall submit the
48 report to the committee, which shall publish the report on its
49 website and shall transmit copies of the report electronically
50 to the President of the Senate and the Speaker of the House of
51 Representatives.
52 Section 2. This act shall take effect July 1, 2024.
