    1                        A bill to be entitled                      
    2         An act relating to county budget officers; amending s.
    3         129.025, F.S.; specifying that the county budget
    4         officer reports directly to the board of county
    5         commissioners; prohibiting such officer from being a
    6         member of the executive branch of county government
    7         unless otherwise authorized; specifying the powers of
    8         certain county entities while acting as ex-officio
    9         budget officers; providing that any actions by such
   10         officers do not violate specified prohibitions;
   11         providing an effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Subsection (1) of section 129.025, Florida
   16  Statutes, is amended to read:
   17         129.025 County budget officer.—
   18         (1)(a) Each board of county commissioners may designate a
   19  county budget officer to carry out the duties set forth in this
   20  chapter. The county budget officer reports directly to the board
   21  and may not be a member of any executive branch of county
   22  government, except as authorized in paragraph (b).
   23         (b) Unless the board designates a different officer, the
   24  clerk of the circuit court or the county comptroller, if
   25  applicable, shall be the ex-officio budget officer for the
   26  purposes of this chapter. The clerk of the circuit court or the
   27  county comptroller, while acting as the ex-officio budget
   28  officer, reports to the board in a strictly legislative
   29  capacity, and any action taken by the clerk of the circuit court
   30  or the county comptroller acting as an ex-officio budget officer
   31  does not violate any prohibition on that individual also working
   32  in an executive branch capacity.
   33         Section 2. This act shall take effect July 1, 2024.
