       Senator Martin moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 800.045, Florida Statutes, is created to
    6  read:
    7         800.045 Lewd or lascivious grooming.—
    8         (1) As used in this section, the term:
    9         (a) “Child” means a person less than 16 years of age.
   10         (b) “Sexual activity” has the same meaning as in s.
   11  800.04(1).
   12         (c) “Sexual conduct” has the same meanings as in s.
   13  847.001.
   14         (d) “Sexual performance” has the same meaning as in s.
   15  827.071(1).
   16         (e) "Unlawful sexual behavior" means any unlawful sexual
   17  activity, unlawful sexual conduct, or unlawful sexual
   18  performance.
   19         (2) A person 18 years of age or older who, with lewd or
   20  lascivious intent, engages in a pattern of verbal, written, or
   21  electronic communication or conduct directed toward a child
   22  which causes, tends to cause, encourages, or contributes to such
   23  child engaging in any unlawful sexual behavior with that person,
   24  commits lewd or lascivious grooming, a felony of the third
   25  degree, punishable as provided in s. 775.082, s. 775.083, or s.
   26  775.084.
   27         Section 2. Paragraphs (c), (e), (f), and (g) of subsection
   28  (3) of section 921.0022, Florida Statutes, are amended to read:
