    1                        A bill to be entitled                      
    2         An act relating to child exploitation offenses;
    3         creating s. 800.045, F.S.; providing definitions;
    4         creating the offense of lewd or lascivious grooming;
    5         providing criminal penalties; amending s. 921.0022,
    6         F.S.; ranking the offense on the offense severity
    7         ranking chart of the Criminal Punishment Code;
    8         revising the ranking of specified child exploitation
    9         offenses for purposes of the offense severity ranking
   10         chart of the Criminal Punishment Code; providing an
   11         effective date.
   12          
   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Section 800.045, Florida Statutes, is created to
   16  read:
   17         800.045 Lewd or lascivious grooming.—
   18         (1) As used in this section, the term:
   19         (a) “Child” means a person less than 16 years of age.
   20         (b) “Inappropriate communication or conduct” means any
   21  verbal, written, or electronic communication or any conduct in
   22  which a person describes, depicts, or demonstrates sexual
   23  conduct or sexual excitement.
   24         (c) “Sexual activity” has the same meaning as in s.
   25  800.04(1).
   26         (d) “Sexual conduct” and the term “sexual excitement” have
   27  the same meanings as in s. 847.001.
   28         (e) “Sexual performance” has the same meaning as in s.
   29  827.071(1).
   30         (f) “Unlawful sexual behavior” means any unlawful sexual
   31  activity, unlawful sexual conduct, or unlawful sexual
   32  performance.
   33         (2) A person 18 years of age or older who, with lewd or
   34  lascivious intent, engages in a pattern of inappropriate
   35  communication or conduct directed toward a child for the purpose
   36  of enticing such child to engage in any unlawful sexual behavior
   37  with that person or the exploitation of such child for human
   38  trafficking as provided in s. 787.06, commits lewd or lascivious
   39  grooming, a felony of the third degree, punishable as provided
   40  in s. 775.082, s. 775.083, or s. 775.084.
   41         Section 2. Paragraphs (c), (e), (f), and (g) of subsection
   42  (3) of section 921.0022, Florida Statutes, are amended to read:
