    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating s. 944.75,
    3         F.S.; creating the Correctional Facilities Capital
    4         Improvement Trust Fund within the Department of
    5         Corrections; providing the purpose of the trust fund;
    6         providing for future review and termination or re
    7         creation of the trust fund; providing an effective
    8         date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 944.75, Florida Statutes, is created to
   13  read:
   14         944.75 Correctional Facilities Capital Improvement Trust
   15  Fund.
   16         (1)The Correctional Facilities Capital Improvement Trust
   17  Fund is created within the Department of Corrections. The
   18  purpose of the trust fund is to address the critical fixed
   19  capital outlay needs of state-operated correctional facilities.
   20         (2)Moneys shall be deposited into and the expenditures
   21  made from the trust fund as provided in s. 944.751.
   22         (3)Notwithstanding s. 216.301 and pursuant to s. 216.351,
   23  any balance in the trust fund at the end of any fiscal year
   24  shall remain in the trust fund at the end of the year and shall
   25  be available for carrying out the purpose of the trust fund.
   26         (4)In accordance with s. 19(f), Art. III of the State
   27  Constitution, the Correctional Facilities Capital Improvement
   28  Trust Fund, unless terminated sooner, shall be terminated on
   29  July 1, 2028. Before its scheduled termination, the trust fund
   30  shall be reviewed as provided in s. 215.3206(1) and (2).
   31         Section 2. This act shall take effect July 1, 2024.
