1 A bill to be entitled
2 An act relating to military leave; amending ss. 115.09
3 and 115.14, F.S.; providing that public officials and
4 employees of the state, a county, a municipality, or a
5 political subdivision, respectively, are entitled to
6 their full pay for the first 30 days of military
7 service, if such service is equal to or greater than a
8 specified timeframe; making technical changes;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 115.09, Florida Statutes, is amended to
14 read:
15 115.09 Leave to public officials for military service.—All
16 officials of the state, the several counties of the state, and
17 the municipalities or political subdivisions of the state,
18 including district school and community college officers, which
19 officials are also servicemembers in the National Guard or a
20 reserve component of the Armed Forces of the United States, must
21 shall be granted leave of absence from their respective offices
22 and duties to perform active military service, with the first 30
23 days of any such leave of absence to be with full pay for active
24 federal military service that is equal to or greater than 90
25 consecutive days.
26 Section 2. Section 115.14, Florida Statutes, is amended to
27 read:
28 115.14 Employees.—All employees of the state, the several
29 counties of the state, and the municipalities or political
30 subdivisions of the state must shall be granted leave of absence
31 under the terms of this law; upon such leave of absence being
32 granted such said employee must shall enjoy the same rights and
33 privileges as are hereby granted to officials under this law,
34 insofar as may be, including, without limitation, receiving full
35 pay for the first 30 days for federal military service that is
36 equal to or greater than 90 consecutive days. Notwithstanding
37 the provisions of s. 115.09, the employing authority may
38 supplement the military pay of its officials and employees who
39 are reservists called to active military service after the first
40 30 days in an amount necessary to bring their total salary,
41 inclusive of their base military pay, to the level earned at the
42 time they were called to active military duty. The employing
43 authority shall continue to provide all health insurance and
44 other existing benefits to such officials and employees as
45 required by the Uniformed Services Employment and Reemployment
46 Rights Act, chapter 43 of Title 38 U.S.C.
47 Section 3. This act shall take effect July 1, 2024.
