    1                        A bill to be entitled                      
    2         An act relating to nonprofit agricultural organization
    3         health coverage; creating s. 624.4032, F.S.; providing
    4         a short title; defining the term “nonprofit
    5         agricultural organization”; authorizing nonprofit
    6         agricultural organizations to provide health coverage
    7         to their members; specifying that such health coverage
    8         is not insurance for purposes of the Florida Insurance
    9         Code; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 624.4032, Florida Statutes, is created
   14  to read:
   15         624.4032 Nonprofit agricultural organization health
   16  coverage.—
   17         (1) This section may be cited as the “Nonprofit
   18  Agricultural Organization Health Coverage Act of 2024.”
   19         (2) For purposes of this section, the term “nonprofit
   20  agricultural organization” means an organization that meets all
   21  of the following criteria:
   22         (a) Is domiciled in this state.
   23         (b) Is exempt from federal income tax under s. 501(c)(3) of
   24  the Internal Revenue Code.
   25         (c) Was created primarily to promote programs for the
   26  development of rural communities and the economic stability and
   27  sustainability of farmers in this state.
   28         (d) Exists to serve its members beyond only offering health
   29  coverage.
   30         (e) Collects annual dues from its members.
   31         (f) Was in existence before 1945.
   32         (g) Is composed of members who, collectively, are residents
   33  of the majority of counties in this state.
   34         (3) Notwithstanding any law to the contrary, a nonprofit
   35  agricultural organization may offer health coverage options to
   36  its members. Such health coverage is not insurance for purposes
   37  of the Florida Insurance Code.
   38         Section 2. This act shall take effect July 1, 2024.
