The Committee on Fiscal Policy (Simon) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. This act may be cited as the “Second Chance
6 Act.”
7 Section 2. Paragraph (b) of subsection (17) of section
8 1002.20, Florida Statutes, is amended to read:
9 1002.20 K-12 student and parent rights.—Parents of public
10 school students must receive accurate and timely information
11 regarding their child’s academic progress and must be informed
12 of ways they can help their child to succeed in school. K-12
13 students and their parents are afforded numerous statutory
14 rights including, but not limited to, the following:
15 (17) ATHLETICS; PUBLIC HIGH SCHOOL.—
16 (b) Medical evaluation.—Students must satisfactorily pass a
17 medical evaluation each year and, as applicable under s.
18 1006.20, receive an electrocardiogram before participating in
19 athletics, unless the parent objects in writing based on
20 religious tenets or practices or secures a certificate of
21 medical exception, in accordance with the provisions of s.
22 1006.20(2)(d).
23 Section 3. Paragraphs (c) and (d) of subsection (2) of
24 section 1006.20, Florida Statutes, are amended to read:
25 1006.20 Athletics in public K-12 schools.—
26 (2) ADOPTION OF BYLAWS, POLICIES, OR GUIDELINES.—
27 (c)1. The FHSAA shall adopt bylaws that require all
28 students participating or seeking to participate in
29 interscholastic athletic competition or who are candidates for
30 an interscholastic athletic team to satisfactorily pass a
31 medical evaluation each year before participating in
32 interscholastic athletic competition or engaging in any
33 practice, tryout, workout, conditioning, or other physical
34 activity associated with the student’s candidacy for an
35 interscholastic athletic team, including activities that occur
36 outside of the school year. Such medical evaluation may be
37 administered only by a practitioner licensed under chapter 458,
38 chapter 459, chapter 460, or s. 464.012 or registered under s.
39 464.0123 and in good standing with the practitioner’s regulatory
40 board.
41 2. The FHSAA shall adopt bylaws that require all students
42 participating or seeking to participate in interscholastic
43 athletic competition to pass an electrocardiogram (ECG)
44 screening before participating in interscholastic athletic
45 competition or engaging in any practice, tryout, workout,
46 conditioning, or other physical activity associated with the
47 student’s candidacy for an interscholastic athletic team,
48 including activities that occur outside of the school year. The
49 electrocardiogram screening must be conducted in accordance with
50 standards established by the FHSAA’s Sports Medicine Advisory
51 Committee. Beginning in the 2028-2029 school year and
52 thereafter, every high school student participating or seeking
53 to participate in interscholastic athletic competition for the
54 first time must complete at least one electrocardiogram
55 screening. FHSAA member schools are encouraged to collaborate
56 with public and private partners to offer low cost or free
57 electrocardiogram screenings for this purpose.
58 3. The FHSAA bylaws must shall establish requirements for
59 eliciting a student’s medical history and performing the medical
60 evaluation and electrocardiogram required under this paragraph,
61 which shall include a physical assessment of the student’s
62 physical capabilities to participate in interscholastic athletic
63 competition as contained in a uniform preparticipation physical
64 evaluation and history form. The evaluation form must: shall
65 a. Incorporate the recommendations of the American Heart
66 Association for participation cardiovascular screening.
67 b. and shall Provide a place for the signature of the
68 practitioner performing the evaluation with an attestation that
69 each examination procedure listed on the form was performed by
70 the practitioner or by someone under the direct supervision of
71 the practitioner. The form must shall also contain a place for
72 the practitioner to indicate whether if a referral to another
73 practitioner was made in lieu of completion of a certain
74 examination procedure. The form must shall provide a place for
75 the practitioner to whom the student was referred to complete
76 the remaining sections and attest to that portion of the
77 examination.
78 c. The preparticipation physical evaluation form shall
79 Advise students to complete a cardiovascular assessment and
80 electrocardiogram, shall include information concerning
81 alternative cardiovascular evaluation and diagnostic tests, and
82 require the. results of such medical evaluation to must be
83 provided to the school.
84 d. Include a section to record either a medical clearance
85 by the practitioner allowing the student to participate in
86 interscholastic athletic competition or recommendations for
87 follow-up treatment by an appropriate health care practitioner
88 trained in the diagnosis, evaluation, and management of
89 cardiovascular abnormalities in athletes as defined by the
90 FHSAA’s Sports Medicine Advisory Committee.
91 4. A student is not eligible to participate, as provided in
92 s. 1006.15(3), in any interscholastic athletic competition or
93 engage in any practice, tryout, workout, or other physical
94 activity associated with the student’s candidacy for an
95 interscholastic athletic team until the results of the medical
96 evaluation have been received and approved by the school.
97 (d) Notwithstanding the provisions of paragraph (c), a
98 student may participate in interscholastic athletic competition
99 or be a candidate for an interscholastic athletic team if:
100 1. The parent of the student objects in writing to the
101 student undergoing a medical evaluation or receiving an
102 electrocardiogram because such evaluation or electrocardiogram
103 is contrary to his or her religious tenets or practices.
104 2. A practitioner licensed under chapter 458, chapter 459,
105 chapter 460, or s. 464.012 or registered under s. 464.0123 and
106 in good standing with the practitioner’s regulatory board
107 provides a certificate of medical exception. However, in such
108 case, there is shall be no liability on the part of any person
109 or entity in a position to otherwise rely on the results of such
110 medical evaluation or electrocardiogram for any damages
111 resulting from the student’s injury or death arising directly
112 from the student’s participation in interscholastic athletics
113 where an undisclosed medical condition that would have been
114 revealed in the medical evaluation or electrocardiogram is a
115 proximate cause of the injury or death.
116 3. The student submits a standard form, developed by the
117 FHSAA, to document exceptions granted under this paragraph which
118 must be signed and notarized by a student’s parent or legal
119 guardian and received by the FHSAA member school before a
120 student may participate in any interscholastic activity.
121 Section 4. This act shall take effect July 1, 2025.

136 form for reporting electrocardiogram results;
137 providing an exceptions; requiring students seeking an
138 exception to submit a form developed by the FHSAA
139 before they may participate in an interscholastic
140 activity; providing an effective date.
