       Senator Burton moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Paragraph (j) of subsection (5) of section
    6  456.053, Florida Statutes, is amended to read:
    7         456.053 Financial arrangements between referring health
    8  care providers and providers of health care services.—
    9         (5) PROHIBITED REFERRALS AND CLAIMS FOR PAYMENT.—Except as
   10  provided in this section:
   11         (j) A health care provider who meets the requirements of
   12  paragraphs (b) and (i) shall must disclose the following
   13  information to his or her patient before making a referral:
   14         1. His or her investment interest to his or her patients as
   15  provided in s. 456.052; and
   16         2.His or her status with the entity in which the health
   17  care provider has an investment interest as a nonparticipating
   18  provider for nonemergency services, as those terms are defined
   19  in s. 627.64194, or to a provider, as defined in s. 641.47, not
   20  under contract with the patient’s health maintenance
   21  organization. The disclosure must be in writing and state that
   22  the services will be provided on an out-of-network basis, which
   23  may result in additional cost-sharing responsibilities for the
   24  patient.
   25         Section 2. This act shall take effect July 1, 2025.

   31                        A bill to be entitled                      
   32         An act relating to health care provider referrals;
   33         amending s. 456.053, F.S.; requiring certain health
   34         care providers to disclose, in writing, specified
   35         information to their patients before making a referral
   36         for certain health care services; providing an
   37         effective date.
