    1                        A bill to be entitled                      
    2         An act relating to intestate succession involving
    3         persons born out of wedlock; amending s. 732.108,
    4         F.S.; revising the circumstances used to determine
    5         intestate succession involving certain persons born
    6         out of wedlock; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Paragraph (d) is added to subsection (2) of
   11  section 732.108, Florida Statutes, to read:
   12         732.108 Adopted persons and persons born out of wedlock.—
   13         (2) For the purpose of intestate succession in cases not
   14  covered by subsection (1), a person born out of wedlock is a
   15  descendant of his or her mother and is one of the natural
   16  kindred of all members of the mother’s family. The person is
   17  also a descendant of his or her father and is one of the natural
   18  kindred of all members of the father’s family, if:
   19         (d) The person is not a resident of this state or a citizen
   20  of the United States and has been named a legal heir by a court
   21  in this state or the foreign country in which he or she resides.
   22         Section 2. This act shall take effect July 1, 2025.
