1 A bill to be entitled
2 An act relating to anaphylaxis in public schools;
3 amending s. 1006.07, F.S.; requiring each district
4 school board to ensure that specified emergency action
5 plans are effective at all times when certain students
6 are on campus; requiring each district school board to
7 ensure that school personnel and employees and
8 contracted personnel of before-school and after-school
9 programs at school receive certain training relating
10 to allergic reactions and anaphylaxis; providing
11 requirements for such training; authorizing the State
12 Board of Education to adopt rules; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsection (12) is added to section 1006.07,
18 Florida Statutes, to read:
19 1006.07 District school board duties relating to student
20 discipline and school safety.—The district school board shall
21 provide for the proper accounting for all students, for the
22 attendance and control of students at school, and for proper
23 attention to health, safety, and other matters relating to the
24 welfare of students, including:
25 (12) ANAPHYLAXIS POLICY.—
26 (a) Each district school board shall ensure that for a
27 student with an emergency action plan, his or her emergency
28 action plan is effective at all times when he or she is on
29 campus, including during extracurricular activities, athletics,
30 school dances, and contracted before-school and after-school
31 programs at his or her school. Each district school board shall
32 ensure that each school within the district has provided
33 training to school personnel on preventing and responding to an
34 allergic reaction, including anaphylaxis, and that each before
35 school and after-school program at a school within the district
36 has provided such training to its employees and contracted
37 personnel. The requirements for such training must include
38 training in the administration of emergency epinephrine,
39 including epinephrine autoinjectors and epinephrine nasal
40 sprays.
41 (b) The State Board of Education may adopt rules to
42 administer this subsection, including identifying an approved
43 training curriculum for the training required under this
44 subsection.
45 Section 2. This act shall take effect July 1, 2025.
