       The Committee on Rules (Gruters) recommended the following:
       
    1         Senate Substitute for Amendment (745992) (with title
    2  amendment)

    4         Delete lines 116 - 147
    5  and insert:
    6         (2)Except as provided in subsection (5), beginning July 1,
    7  2026, cosmetics manufactured, sold, offered or distributed for
    8  sale, or distributed for use in this state must provide notice
    9  on such cosmetics’ single-use packaging of the following
   10  intentionally added chemicals or chemical classes:
   11         (a)Ortho-phthalates.
   12         (b)PFAS.
   13         (c)Formaldehyde as identified in CAS 50-00-0.
   14         (d)Methylene glycol as identified in CAS 463-57-0.
   15         (e)Mercury as identified in CAS 7439-97-6.
   16         (f)Triclosan as identified in CAS 3380-34-5.
   17         (g)M-phenylenediamine or its salt derivatives as
   18  identified in CAS 108-45-2.
   19         (h)O-phenylenediamine or its salt derivatives as
   20  identified in CAS 95-54-5.
   21         (3)Except as provided in subsection (5), beginning July 1,
   22  2026, cosmetics manufactured, sold, offered or distributed for
   23  sale, or distributed for use in this state must provide notice
   24  on such cosmetics’ single-use packaging of any lead or lead
   25  compounds as identified by CAS 7439-92-1, whether intentionally
   26  added or naturally occurring, at 10 parts per million or more,
   27  or as otherwise determined by department rule.
   28         (4) Except as provided in subsection (5), beginning July 1,
   29  2026, cosmetics manufactured, sold, offered or distributed for
   30  sale, or distributed for use in this state may not release
   31  formaldehyde as identified in paragraph (2)(c) unless it is a
   32  natural byproduct with no functional or technical purpose.
   33         (5)A retailer in possession of cosmetics that do not
   34  comply with the requirements of this section as of July 1, 2026,
   35  may exhaust its existing stock through sales to the public until
   36  July 1, 2027.
   37         (6)A violation of this section is subject to the penalties
   38  and remedies provided in s. 499.066.
   39         (7)This section does not apply to cosmetic products
   40  regulated as drugs by the United States Food and Drug
   41  Administration.
   42         (8)The department may adopt rules necessary to implement
   43  this section.
