       Senator Martin moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. This act may be cited as “Lucy’s Law.”
    6         Section 2. Subsection (24) of section 327.02, Florida
    7  Statutes, is amended to read:
    8         327.02 Definitions.—As used in this chapter and in chapter
    9  328, unless the context clearly requires a different meaning,
   10  the term:
   11         (24) “Livery vessel” means a leased or rented vessel
   12  leased, rented, or chartered to another for consideration.
   13         Section 3. Subsection (5) of section 327.30, Florida
   14  Statutes, is amended to read:
   15         327.30 Collisions, accidents, and casualties.—
   16         (5) It is unlawful for a person operating a vessel involved
   17  in an accident or injury to leave the scene of the accident or
   18  injury without giving all possible aid to all persons involved
   19  and making a reasonable effort to locate the owner or persons
   20  affected and subsequently complying with and notifying the
   21  appropriate law enforcement official as required under this
   22  section.
   23         (a)If a Any person who violates this subsection and the
   24  with respect to an accident results resulting in:
   25         1.Property damage only, the person commits a misdemeanor
   26  of the first degree, punishable as provided in s. 775.082 or s.
   27  775.083.
   28         2.Injury to a person other than serious bodily injury, the
   29  person commits a felony of the third degree, punishable as
   30  provided in s. 775.082, s. 775.083, or s. 775.084.
   31         3.Serious bodily injury, the person commits a felony of
   32  the second degree, punishable as provided in s. 775.082, s.
   33  775.083, or s. 775.084.
   34         4.The death of another person or an unborn child, the
   35  person commits a felony of the first degree, punishable as
   36  provided in s. 775.082, s. 775.083, or s. 775.084.
   37         (b)If a person operating a vessel involved in an accident
   38  that results in the death of another person or an unborn child
   39  provides a false statement to an investigating law enforcement
   40  officer, the person personal injury commits a felony of the
   41  third degree, punishable as provided in s. 775.082 or s. 775.083
   42  s. 775.082, s. 775.083, or s. 775.084. Any person who violates
   43  this subsection with respect to an accident resulting in
   44  property damage only commits a misdemeanor of the second degree,
   45  punishable as provided in s. 775.082 or s. 775.083.
   46         Section 4. Subsection (1) of section 327.33, Florida
   47  Statutes, is amended to read:
   48         327.33 Reckless or careless operation of vessel.—
   49         (1) It is unlawful to operate a vessel in a reckless
   50  manner. A person who operates any vessel, or manipulates any
   51  water skis, aquaplane, or similar device, in willful or wanton
   52  disregard for the safety of persons or property at a speed or in
   53  a manner as to endanger, or likely to endanger, life or limb, or
   54  damage the property of, or injure a person is guilty of reckless
   55  operation of a vessel. Reckless operation of a vessel includes,
   56  but is not limited to, a violation of s. 327.331(6). If a person
   57  who violates this subsection and the violation:
   58         (a)Does not result in an accident, the person commits a
   59  misdemeanor of the second degree, punishable as provided in s.
   60  775.082 or s. 775.083.
   61         (b)Results in an accident that causes damage to the
   62  property or person of another, the person commits a misdemeanor
   63  of the first degree, punishable as provided in s. 775.082 or s.
   64  775.083.
   65         (c)Results in an accident that causes serious bodily
   66  injury as defined in s. 316.192, the person commits a felony of
   67  the second degree, punishable as provided in s. 775.082, s.
   68  775.083, or s. 775.084.
   69         Section 5. Subsection (10) of section 327.395, Florida
   70  Statutes, is amended to read:
   71         327.395 Boating safety education.—
   72         (10) The commission shall design forms and adopt rules
   73  pursuant to chapter 120 to implement this section. Any such
   74  rules must establish minimum standards for online boating safety
   75  education courses offered, including curriculum requirements,
   76  assessment methods, and provider qualifications. The standards
   77  must, at a minimum, align with the education standards set by
   78  the National Association of State Boating Law Administrators and
   79  may include additional requirements as necessary to promote
   80  effective and accessible online boating safety education in this
   81  state. All online course providers must be approved by the
   82  commission and demonstrate compliance with the standards
   83  prescribed by commission rule before offering courses to the
   84  public.
   85         Section 6. Paragraph (c) of subsection (1) of section
   86  327.54, Florida Statutes, is amended to read:
   87         327.54 Liveries; safety regulations; penalty.—
   88         (1) As used in this section, the term:
   89         (c) “Livery” means a person who advertises and offers a
   90  livery vessel for use by another in exchange for any type of
   91  consideration when such person does not also provide or does not
   92  require the lessee or renter to provide as a condition of the
   93  rental or lease agreement a person licensed by the United States
   94  Coast Guard to serve as master of the vessel or to with a
   95  captain, a crew, or any type of staff or personnel to operate,
   96  oversee, maintain, or manage the vessel. The owner of a vessel
   97  who does not advertise his or her vessel for use by another for
   98  consideration and who loans or offers his or her vessel for use
   99  to another known to him or her either for consideration or
  100  without consideration is not a livery. A public or private
  101  school or postsecondary institution located within this state is
  102  not a livery. A vessel rented or leased by a livery is a livery
  103  vessel as defined in s. 327.02.
  104         Section 7. Present subsections (2), (3), and (4) of section
  105  327.731, Florida Statutes, are redesignated as subsections (3),
  106  (4), and (5), respectively, a new subsection (2) is added to
  107  that section, and subsection (1) and present subsection (3) of
  108  that section are amended, to read:
  109         327.731 Mandatory education for violators.—
  110         (1) A person convicted of a criminal violation under this
  111  chapter, convicted of a noncriminal infraction under this
  112  chapter if the infraction resulted in a reportable boating
  113  accident, or convicted of a two noncriminal infraction
  114  infractions as specified in s. 327.73(1)(h)-(k), (m), (o), (p),
  115  (t), (u), (w), (x), and (y) and (s)-(y), the infractions
  116  occurring within a 12-month period, must:
  117         (a) Enroll in, attend, and successfully complete, at his or
  118  her own expense, a classroom or online boating safety course
  119  that is approved by and meets the minimum standards established
  120  by commission rule;
  121         (b) File with the commission within 90 days proof of
  122  successful completion of the course; and
  123         (c) Refrain from operating a vessel until he or she has
  124  filed proof of successful completion of the course with the
  125  commission; and
  126         (d) Pay a fine of $500. The clerk of the court shall remit
  127  all fines assessed and collected under this paragraph to the
  128  Department of Revenue to be deposited into the Marine Resources
  129  Conservation Trust Fund to support law enforcement activities.
  130         (2) A person convicted of a criminal violation under this
  131  chapter, convicted of a noncriminal infraction under this
  132  chapter if the infraction resulted in a reportable boating
  133  accident, or convicted of two noncriminal infractions as
  134  specified in s. 327.73(1)(h)-(k), (o), (p), (t), (u), (w), (x),
  135  and (y), occurring within a 12-month period, must pay a fine of
  136  $500 and complete a boater safety education course that meets
  137  the requirements of s. 327.395. The clerk of the court shall
  138  remit all fines assessed and collected under this subsection to
  139  the Department of Revenue to be deposited into the Marine
  140  Resources Conservation Trust Fund to support law enforcement
  141  activities.
  142         (4)(3) The commission shall print on the reverse side of
  143  the defendant’s copy of the boating citation a notice of the
  144  provisions of this section. Upon conviction, the clerk of the
  145  court shall notify the defendant that it is unlawful for him or
  146  her to operate any vessel until he or she has complied with this
  147  section, but failure of the clerk of the court to provide such a
  148  notice shall not be a defense to a charge of unlawful operation
  149  of a vessel under subsection (3) (2).
  150         Section 8. Section 782.072, Florida Statutes, is amended to
  151  read:
  152         782.072 Vessel homicide.—
  153         (1)As used in this section, the term:
  154         (a)“Unborn child” has the same meaning as in s.
  155  775.021(5)(e).
  156         (b) “Vessel homicide” means is the killing of a human
  157  being, including the death of an unborn child caused by injury
  158  to the mother, by the operation of a vessel as defined in s.
  159  327.02 by another in a reckless manner likely to cause the death
  160  of, or great bodily harm to, another.
  161         (2) Vessel homicide is:
  162         (a)(1) A felony of the second degree, punishable as
  163  provided in s. 775.082, s. 775.083, or s. 775.084.
  164         (b)(2) A felony of the first degree, punishable as provided
  165  in s. 775.082, s. 775.083, or s. 775.084, if:
  166         1.(a) At the time of the accident, the person knew, or
  167  should have known, that the accident occurred; and
  168         2.(b) The person failed to give information and render aid
  169  as required by s. 327.30(1).

  171  This subsection does not require that the person knew that the
  172  accident resulted in injury or death.
