       The Committee on Fiscal Policy (Burgess) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 23 - 37
    4  and insert:
    5         (b) Each MS4 entity shall conduct an operation and
    6  maintenance inspection of all permitted stormwater management
    7  systems owned or operated by the MS4 entity by September 1,
    8  2026. As part of such inspection, the MS4 entity must identify
    9  any infrastructure within the MS4, or any component thereof,
   10  which:
   11         1. Has a significant vulnerability to obstruction,
   12  blockage, deterioration, failure, or other deficiencies; and
   13         2. Upon operational failure, would result in flooding and
   14  property damage.
   15         (c) Any infrastructure that satisfies the conditions in
   16  either subparagraph (b)1. or subparagraph (b)2. must be
   17  inspected annually by each June 1 thereafter.
   18         (d) The MS4 entity shall complete the stormwater facility
   19  inspection checklist developed by the department any time an MS4
   20  is inspected pursuant to this subsection. A completed checklist
   21  must be submitted to the department and the Division of
   22  Emergency Management by September 1, 2026, and as applicable,
   23  each September 1 thereafter. Each checklist must include any
   24  infrastructure

   27  And the title is amended as follows:
   28         Delete lines 5 - 10
   29  and insert:
   30         an annual operation and maintenance inspection of
   31         certain stormwater management systems; providing
   32         requirements for such inspection; requiring that
   33         certain infrastructure be inspected annually by a
   34         specified date; requiring each MS4 entity to complete
   35         a stormwater facility inspection checklist; requiring
   36         that such checklist be submitted to specified entities
   37         by a specified date;
