The Committee on Rules (Massullo) recommended the following:
1 Senate Amendment to Amendment (249874) (with title
2 amendment)

4 Between lines 390 and 391
5 insert:
6 (3) APPLICABILITY; HISTORIC PRESERVATION.—
7 (a) This section does not apply to an application for a
8 permit if the property that is the subject of the application
9 is:
10 1. Individually listed in the National Register of Historic
11 Places or is a contributing property within a National Register
12 listed historic district;
13 2. Designated as a local historic landmark, historic
14 resource, or part of a locally designated historic district
15 under a duly adopted local historic preservation ordinance; or
16 3. Subject to binding historic preservation review or
17 approval under federal, state, or local law, including review by
18 a local historic preservation board or commission.
19 (b) If an application encompasses multiple parcels or
20 improvements, this subsection applies only to the portion of the
21 application that relates to property described in paragraph (a).
22 This subsection may not be construed to prohibit the use of a
23 qualified contractor for the portions of an application that do
24 not involve the property listed in paragraph (a).
