       The Committee on Fiscal Policy (Harrell) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. This act may be cited as the “Joe Casello Act.″
    6         Section 2. Section 376.911, Florida Statutes, is created to
    7  read:
    8         376.911Aqueous film-forming foam.—
    9         (1)As used in this section, the term:
   10         (a) “Aqueous film-forming foam” means any firefighting foam
   11  containing intentionally added perfluoroalkyl and
   12  polyfluoroalkyl substances, including perfluorooctanoic acid and
   13  perfluorooctane sulfonate as defined by the United States
   14  Environmental Protection Agency.
   15         (b)“Department” means the Department of Environmental
   16  Protection.
   17         (2)Effective July 1, 2026:
   18         (a)Aqueous film-forming foam may not be used for any
   19  nonemergency instruction, training, or testing.
   20         (b)All entities in possession of aqueous film-forming foam
   21  must report inventories to the department.
   22         (3)Effective July 1, 2027:
   23         (a)The sale, purchase, or distribution of aqueous film
   24  forming foam within this state is prohibited.
   25         (b)All entities with remaining inventories of aqueous
   26  film-forming foam must submit a disposal plan to the department.
   27         (4)Effective July 1, 2029, the possession and use of
   28  aqueous film-forming foam is prohibited in this state.
   29         (5)The prohibition under subsection (4) does not apply to:
   30         (a)Federal aviation facilities required to comply with 14
   31  C.F.R. part 139.
   32         (b)Military applications where alternatives do not exist.
   33         (c)Emergency firefighting situations where alternative
   34  firefighting foam is not available, including mutual aid where
   35  state or local firefighting authorities may not have adequate
   36  equipment to dispense alternatives.
   37         (d)Specific aqueous film-forming foam retrofit projects
   38  submitted under an application with state or local firefighting
   39  authorities.
   40         (6)The department shall:
   41         (a)Adopt rules for containment, collection, and disposal
   42  of aqueous film-forming foam.
   43         (b)Maintain a registry of firefighting foam alternatives
   44  that do not contain perfluoroalkyl and polyfluoroalkyl
   45  substances.
   46         (c)Provide technical assistance and grants for transition
   47  to products that do not contain perfluoroalkyl and
   48  polyfluoroalkyl substances.
   49         (7)The department may administer grants or cost-share
   50  programs to assist local fire departments and airports in
   51  transitioning to products that do not contain perfluoroalkyl and
   52  polyfluoroalkyl substances.
   53         (8)A person who violates this act is subject to:
   54         (a)Civil penalties not to exceed $10,000 for each
   55  violation for each day the violation persists.
   56         (b)Additional penalties for failure to report inventories
   57  or submit disposal plans.
   58         (9)The department may seek injunctive relief to enforce
   59  compliance with this section.
   60         Section 3. Subsection (12) is added to section 403.086,
   61  Florida Statutes, to read:
   62         403.086 Sewage disposal facilities; advanced and secondary
   63  waste treatment.—
   64         (12)(a)All public entities disposing of domestic
   65  wastewater biosolids and treated effluent that have a designed
   66  average daily flow of 25,000 or more gallons per day must
   67  quarterly conduct at least one biosolids and treated effluent
   68  sampling, as applicable, for perfluoroalkyl and polyfluoroalkyl
   69  substances, including perfluorooctanoic acid and perfluorooctane
   70  sulfonate, and submit the results to the department. The
   71  sampling must be conducted in accordance with department rules.
   72         (b)Until water quality standards for perfluoroalkyl and
   73  polyfluoroalkyl substances are established by the United States
   74  Environmental Protection Agency and adopted by the department,
   75  the sampling and reporting conducted pursuant to paragraph (a)
   76  is for informational purposes only and may not be the basis for
   77  any department enforcement action or other cause of action.
   78         Section 4. This act shall take effect July 1, 2026.

   90         purchase, or distribution of aqueous film-forming
   91         foam; requiring, beginning on a specified date,
   92         certain entities to submit aqueous film-forming foam
   93         inventories and disposal plans to the Department of
   94         Environmental Protection; prohibiting, beginning on a
   95         specified date, the possession and use of aqueous
   96         film-forming foam; providing applicability; providing
   97         duties of the department; authorizing the department
   98         to administer certain grants or cost-share programs;
   99         providing penalties and injunctive relief; amending s.
  100         403.086, F.S.; requiring certain public entities
  101         disposing of domestic wastewater biosolids and treated
  102         effluent to quarterly conduct specified samplings and
  103         submit the results to the department; requiring that
  104         such sampling be conducted in accordance with
  105         department rules; providing that such sampling is for
  106         informational purposes only, and may not be the basis
  107         for enforcement action or other causes of action,
  108         until the department adopts certain water quality
  109         standards; providing an effective date.
