The Committee on Fiscal Policy (Harrell) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. This act may be cited as the “Joe Casello Act.”
6 Section 2. Section 376.911, Florida Statutes, is created to
7 read:
8 376.911 Aqueous film-forming foam.—
9 (1) As used in this section, the term “aqueous film-forming
10 foam” means any firefighting foam containing intentionally added
11 perfluoroalkyl and polyfluoroalkyl substances, including
12 perfluorooctanoic acid and perfluorooctane sulfonate as defined
13 by the United States Environmental Protection Agency.
14 (2) Effective July 1, 2026:
15 (a) Aqueous film-forming foam may not be used for any
16 nonemergency instruction, training, or testing.
17 (b) All entities in possession of aqueous film-forming foam
18 must report inventories to the department.
19 (3) Effective July 1, 2027:
20 (a) The sale, purchase, or distribution of aqueous film
21 forming foam within this state is prohibited.
22 (b) All entities with remaining inventories of aqueous
23 film-forming foam must submit a disposal plan to the department.
24 (4) Effective July 1, 2028, the possession and use of
25 aqueous film-forming foam is prohibited in this state.
26 (5) The prohibition under subsection (4) does not apply to:
27 (a) Federal aviation facilities required to comply with 14
28 C.F.R. part 139.
29 (b) Military applications where alternatives do not exist.
30 (c) Emergency firefighting situations where alternative
31 firefighting foam is not available.
32 (6) The department shall:
33 (a) Adopt rules for containment, collection, and disposal
34 of aqueous film-forming foam.
35 (b) Maintain a registry of firefighting foam alternatives
36 that do not contain perfluoroalkyl and polyfluoroalkyl
37 substances.
38 (c) Provide technical assistance and grants for transition
39 to products that do not contain perfluoroalkyl and
40 polyfluoroalkyl substances.
41 (7) The department may administer grants or cost-share
42 programs to assist local fire departments and airports in
43 transitioning to products that do not contain perfluoroalkyl and
44 polyfluoroalkyl substances.
45 (8) A person who violates this act is subject to:
46 (a) Civil penalties not to exceed $10,000 for each
47 violation for each day the violation persists.
48 (b) Additional penalties for failure to report inventories
49 or submit disposal plans.
50 (c) The department may seek injunctive relief to enforce
51 compliance with this section.
52 Section 3. Subsection (12) is added to section 403.086,
53 Florida Statutes, to read:
54 403.086 Sewage disposal facilities; advanced and secondary
55 waste treatment.—
56 (12) All public entities disposing of domestic wastewater
57 biosolids and treated effluent that have a designed average
58 daily flow of 25,000 or more gallons per day must quarterly
59 conduct at least one biosolids and treated effluent sampling, as
60 applicable, for perfluoroalkyl and polyfluoroalkyl substances,
61 including perfluorooctanoic acid and perfluorooctane sulfonate,
62 and submit the results to the department. The sampling must be
63 conducted in accordance with department rules.
64 Section 4. This act shall take effect July 1, 2026.

76 or testing; requiring all entities in possession of
77 aqueous film-forming foam to report inventories to the
78 Department of Environmental Protection; prohibiting,
79 beginning on a specified date, certain use and the
80 sale, purchase, or distribution of aqueous film
81 forming foam; requiring, beginning on a specified
82 date, certain entities to submit aqueous film-forming
83 foam inventories and disposal plans to the department;
84 prohibiting, beginning on a specified date, the
85 possession and use of aqueous film-forming foam;
86 providing applicability; providing duties of the
87 department; authorizing the department to administer
88 certain grants or cost-share programs; providing
89 penalties and injunctive relief; amending s. 403.086,
90 F.S.; requiring certain public entities disposing of
91 domestic wastewater biosolids and treated effluent to
92 quarterly conduct specified samplings and submit the
93 results to the Department of Environmental Protection;
94 providing an effective date.
