       Senator Bracy Davis moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 61 - 69
    4  and insert:
    5         (2)(a) The victim of any offense described in subsection
    6  (1) was a law enforcement officer, part-time law enforcement
    7  officer, auxiliary law enforcement officer, correctional
    8  officer, part-time correctional officer, auxiliary correctional
    9  officer, correctional probation officer, part-time correctional
   10  probation officer, or auxiliary correctional probation officer,
   11  as those terms are defined in s. 943.10, who was engaged in the
   12  performance of his or her official duties as described in s.
   13  943.10; or lawful performance of a legal duty
   14         (b)The defendant in any offense described in subsection
   15  (1) was a law enforcement officer, part-time law enforcement
   16  officer, auxiliary law enforcement officer, correctional
   17  officer, part-time correctional officer, auxiliary correctional
   18  officer, correctional probation officer, part-time correctional
   19  probation officer, or auxiliary correctional probation officer,
   20  as those terms are defined in s. 943.10, whose criminal conduct
   21  emerged within the context of the performance of his or her
   22  official duties as described in s. 943.10, even if such conduct
   23  exceeded the scope of his or her official duties.
