Senator Smith moved the following:

4 insert:
5 Section 2. Section 383.3363, Florida Statutes, is created
6 to read:
7 383.3363 Education on drowning prevention safety measures
8 and safe bathing practices.—
9 (1) The Department of Health shall develop educational
10 materials on drowning prevention safety measures and safe
11 bathing practices to be distributed to parents or caregivers as
12 part of postpartum or childbirth education provided by
13 hospitals, birth centers, home birth providers, and childbirth
14 educators in this state. The materials must include, but need
15 not be limited to, instruction on all of the following:
16 (a) The increased risk of drowning for infants and toddlers
17 in bathtubs, pools, and other water sources, citing available
18 data on such drownings.
19 (b) Water safety measures parents can employ to prevent
20 drowning, emphasizing the importance of constant supervision of
21 infants and children while they are around water and the
22 benefits of early childhood swimming lessons and water
23 competency programs as an added layer of protection from
24 drowning.
25 (c) Additional safety hazards in the home setting and
26 evidence-based safe bathing practices.
27 (2) Hospitals, birth centers, and home birth providers
28 providing maternity, prenatal, and newborn services shall
29 provide the educational materials developed under subsection (1)
30 to the parents or caregivers of a newborn as part of their
31 postpartum education and care.
32 (3) Childbirth educators shall provide the educational
33 materials developed under subsection (1) to the parents or
34 caregivers receiving childbirth education.
35 Section 3. Paragraph (j) is added to subsection (4) of
36 section 383.318, Florida Statutes, to read:
37 383.318 Postpartum care for birth center clients and
38 infants.—
39 (4) The birth center shall provide a postpartum evaluation
40 and follow-up followup care that includes all of the following:
41 (j) Provision of the educational materials on drowning
42 prevention safety measures and safe bathing practices developed
43 by the Department of Health under s. 383.3363.
44 Section 4. Section 395.1053, Florida Statutes, is amended
45 to read:
46 395.1053 Postpartum education.—A hospital that provides
47 birthing services shall provide each parent with postpartum
48 education on the care of newborns, which must include all of the
49 following:
50 (1) incorporate Information on safe sleep practices and the
51 possible causes of Sudden Unexpected Infant Death. into the
52 hospital’s postpartum instruction on the care of newborns and
53 provide to each parent
54 (2) The informational pamphlet on infant and childhood eye
55 and vision disorders created by the department pursuant to s.
56 383.14(3)(h).
57 (3) The educational materials on drowning prevention safety
58 measures and safe bathing practices developed by the department
59 under s. 383.3363.

67 children receiving a voucher through the Swimming

69 requiring the Department of Health to develop
70 educational materials on drowning prevention safety
71 measures and safe bathing practices for specified
72 purposes; specifying requirements for such materials;
73 requiring hospitals, birth centers, and home birth
74 providers to provide the educational materials to new
75 parents and caregivers as part of their postpartum
76 education and care; requiring childbirth educators to
77 provide the informational materials to parents or
78 caregivers receiving childbirth education; amending
79 ss. 383.318 and 395.1053, F.S.; conforming provisions
80 to changes made by the act; providing an
