       The Appropriations Committee on Criminal and Civil Justice
       (Garcia) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 139 and 140
    4  insert:
    5         Section 4. Section 45.031, Florida Statutes, is amended to
    6  read:
    7         45.031 Judicial sales procedure.—In any sale of real or
    8  personal property under an order or judgment, the procedures
    9  provided in this section and ss. 45.0315-45.035 must may be
   10  followed as an alternative to any other sale procedure if so
   11  ordered by the court.
   12         Section 5. Section 56.35, Florida Statutes, is created to
   13  read:
   14         56.35Judicial Sales.—A sale of real property under an
   15  order or judgment of a court must be conducted by the clerk of
   16  court.

   19  And the title is amended as follows:
   20         Delete line 7
   21  and insert:
   22         changes made by the act; amending s. 42.031, F.S.;
   23         45.031, F.S.; requiring rather than allowing certain
   24         procedures be used in a judicial foreclosure sale;
   25         creating s. 56.35, F.S.; providing that only a clerk
   26         of court may conduct a judicial sale of real property
   27         in a civil action; providing an effective date.
