       The Committee on Judiciary (Simon) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 522 - 530
    4  and insert:
    5         Section 2. Subsection (6) of section 1002.31, Florida
    6  Statutes, is amended to read:
    7         1002.31 Controlled open enrollment; public school parental
    8  choice.—
    9         (6)(a) A school district or charter school may not delay
   10  eligibility or otherwise prevent a student participating in
   11  controlled open enrollment or a choice program from being
   12  immediately eligible to participate in interscholastic and
   13  intrascholastic extracurricular activities.
   14         (b) A student may not participate in a sport if the student
   15  participated in that same sport at another school during that
   16  school year, unless the student meets one of the following
   17  criteria:
   18         1. Dependent children of active duty military personnel
   19  whose move resulted from military orders.
   20         2. Children who have been relocated due to a foster care
   21  placement in a different school zone.
   22         3. Children who move due to a court-ordered change in
   23  custody due to separation or divorce, or the serious illness or
   24  death of a custodial parent.
   25         4.Authorized for good cause in district or charter school
   26  policy.
   27         Section 3. Subsection (11) of section 1002.33, Florida
   28  Statutes, is amended to read:
   29         1002.33 Charter schools.—
   30         (11) PARTICIPATION IN INTERSCHOLASTIC EXTRACURRICULAR
   31  ACTIVITIES.—A charter school student is eligible to participate
   32  in an interscholastic extracurricular activity at the public
   33  school to which the student would be otherwise assigned to
   34  attend, or may develop an agreement to participate at a private
   35  school, pursuant to s. 1006.15(4) s. 1006.15(3)(d).

   38  And the title is amended as follows:
   39         Delete line 38
   40  and insert:
   41         s. 1002.31, F.S.; deleting obsolete language; amending
   42         s. 1002.33, F.S.; conforming a cross-reference and
   43         provisions to changes made by the act;
